School staff, teaching and non-teaching will no longer have to go to court to air their grievances. The state government on Wednesday announced that a West Bengal administrative adjudication of school disputes commission will be set up to settle disputes between the school staff and the management. All cases would now come up for discussions at the commission, which will act as a tribunal for settling disputes. Government officials reasoned that the pending cases had created a huge backlog at courts.
"The Cabinet has cleared the proposal for setting up the commission," said chief secretary AK Deb on Wednesday. The move, however, has not gone down well with teachers' associations. Many teachers' associations felt this would not only complicate matters, but will also delay justice. Till date, teachers could move court against the school management. But teachers think that now, the commission will come to the stage to hold up matters.
"Most of the education-related cases pending in the high court are those between schools and their staff. In most such cases, courts have ruled in favour of teachers and the judgments have caused great embarrassment to the state. This is the reason why it is now creating this commission as a buffer," said Secondary Teachers' and Employees' Association member Ratan Laskar.
The Centre had once proposed that such a commission be set up for services like education, health, civic amenities etc. But the proposal was shelved after protests. "I think this proposal is related to the original one that the Centre had proposed. The commission will have key government officials and will obviously not be an unbiased body. People move court looking for justice from an impartial agency. This purpose will be defeated if one has to first complain to the commission, wait for its judgement and then move court," said Headmasters' Association members. Source:The Times Of India,21-02-08
