Cestat Bench To Go On Eastern CircuitBy sachiv1, Section News
The Kolkata Bench of the Customs, Excise & Service Tax Tribunal (Cestat) has agreed to travel to all important cities of eastern India, beginning with Bhubaneswar in the first week of June.
The bench, which has cleared over 1000 appeals since it was reconstituted on February 7, took the decision to hold circuit benches following representations from tax lawyers and consultants, who otherwise have to travel repeatedly to Kolkata. After sitting in Bhubaneswar from June 4 to June 8, the bench will travel to Siliguri, Jamshedpur, Ranchi and Shillong later this year. The local commissioners of customs and excise at each centre will be providing the basic infrastructure required to hold these circuit benches. The Kolkata Bench has taken several practical measures so far to clear the large number of tax disputes pending before it, with hundreds of crores of rupees at stake. While many of these cases involved blue-chips like Tata Chemicals, Tata Steel, Tata Motors, Bata and Hindustan Lever, the Cestat bench also made special efforts to clear the cases of small taxpayers.
It has been clubbing cases involving similar issues, hearing cases in detail at the admission stage and deciding them at one go without granting stays, and holding special sittings for small appeals in the afternoon.
On some occasions, the bench split into two, with its members C Satapathy and DN Panda forming two single member Benches to decide a large number of small appeals. With lawyers, clients, departmental representatives and the registry cooperating, the Cestat bench has speeded up decisions from 65 appeals a month earlier to over 300 a month now, reducing the pending cases to around 1900.
