Beach hotels face axe, Court Directs Authorities To Take Action Against Hoteliers Flouting RulesBy Mrs Gupta, Section News
Hotels and resorts lining the Mandarmoni beach 15 km from Digha may soon be consigned to history if Calcutta High Court has its way. On Friday, the court directed the authorities concerned to take action against all those, who have flouted rules while building hotels and resorts there.
On December 15, 1990, the Union ministry of environment and forest earmarked a coastal regulation zone for the entire country. The regulations prohibit all commercial activity including construction of shopping malls, housing complex, hotels and entertainment centres within 200 metre of the high tide mark. Mandarmoni, a small fishing hamlet in East Midnapore, shot into limelight a few years ago and gradually developed into a major tourist attraction. Initially, tourists visiting Digha used to spend a day in Mandarmoni. Over the years, hotels, resorts, shopping malls and housing complexes mushroomed along the beach.
Society for Direct Initiative for Social and Health Action filed a public interest litigation in the high court green Bench, complaining of rampant violation of regulations by the hotels and other establishments. The petitioners submitted the result of a survey conducted by them. It revealed that construction has been going on within 30-50 metre of the high tide line.
The petitioners appended a report of the appellate authority of the West Bengal Pollution Control Board, which says that closure notices have been served on eight hotels in Mandarmoni. These are Tarangamala, Rose Valley Resort, Oswal Vyapaar (P) Ltd, Samudra Sakshi, Samudra Bilas, Hirak Nath Sahoo, Susanta Kumar Sahoo and Debraj Hotel. These establishments allegedly did not obtain the necessary clearance either from the coastal regulatory authority or WBPCB. In an altogether separate case which is still pending in the high court the closure notices were stayed. After considering the petitioners’ survey report, the green Bench of Justice Pinaki Chandra Ghosh and Justice Biswanath Somadder directed the National Coastal Regulation Zone Management Authority and the West Bengal Coastal Regulation Zone Management Authority to take action within six weeks. “Following the court order, the regulatory authority may order demolition of unauthorised constructions on the beach,” said Sadhan Roy Chowdhury, counsel for the petitioner.
