High Court cancels land allotted to Prakash Jha for multiplexesBy Mrs Gupta, Section News
T HE Patna High Court today quashed allotment of land made by the state Government to noted film-maker Prakash Jha, for building a chain of multiplexes acrossdifferenttownsofBihar.
A division Bench of the court comprising Justices Aftab Alam and Rekha Kumari termed the allotment as illegal and directed the Government to take possession of all the land allotted to Jha's company Holy Cow Pictures Pvt Ltd. The court also ruled that if Jha's company wanted land then it should do so through a proper application. The state Government was also asked to report within three months about the status ofthelandsallottedtohiscompany. Details of the judgment are awaited. This ruling came on a Public Interest Litigation (PIL) filed by Congress leader Premchand Mishra. In his petition Mishra said that allotment of land by the Industry Department of the state Government was illegal on four grounds. Firstly, there was no public notice nor tenders were invited fortheallotment.Second,land was allotted to Jha's company much below the market price. Thirdly, multiplex is not an industry according to the indus trialpolicyofthestateGovern- ment, and finally, land was al- lotted to him even before he had applied for it. An upbeat Lalu Yadav im- mediately used the verdict to demand the resignation of Ni- tish Kumar. "The court's ver- dict is a slap on the face of the state government which had allotted precious land to Prakash Jha at a throw-away price. Now, there is no moral right for this Government to continue in office," Lalu declared. Petitioner and CongressleaderMishratoomadea similar demand and said that Jha was favoured since he had campaigned for itish Kumar in the Assembly polls.
A total of 11 acres of land was allotted to Prakash Jha's company Holy Cow Pictures PvtLtdinsixdifferenttownsof Bihar, including Patna for buildingmultiplexesandshopping malls. Apart from the state capital land was allotted in Hajipur, Muzaffarpur, Sitamarhi, Buxar and Aurangabad.Butitwas32cottahs (1acre)oflandintheprimeindustrial area of Patliputra colony of Patna which had led to the entire controversy and the PIL was filed on July 17. The 32 cottahs of land was allotted for Rs 14 lakh which accordingtothepetitionerwas six times below the market price.Mishrasaidthatrecently the Patna Regional Development Authority (PRDA) had invited global tenders for a multiplex in the Rajendra Nagar area of Patna. "But for Jha there was no tender. Why this double standard?" the Congress leader remarked. After this verdict Jha could not be contacted despite best efforts.
