Question: I am writing on behalf of my parents (both senior citizens) who are faced with a terrible dilemma. They are simply unable to register their Calcutta flat because the previous owner (who now lives in Chennai) refuses to provide a letter of affidavit, which in turn will allow my parents to register their flat.
No amount of polite requests has succeeded in the previous owner willing to provide the necessary documents that will facilitate the registration.
Since they are unable to register, they are unable to sell their flat and move to Chennai where they can avail themselves of medical amenities and the assistance of relatives - my father is a diabetic and a heart-patient.
Please advice as to what recourse, if any, exists for the registration process to be conducted other than getting the previous owner to cooperate. Is there any other legal recourse for the registration of the flat?
